1. We make no earnings claims

1.1 We do not promise, guarantee, warrant or represent that you will earn any money, generate any revenue, receive any advertising income, gain any subscribers, views or followers, or achieve any other financial or commercial result from the Nocturnal Studios Founder Programme.

1.2 We make no representation about your future income, business results, employment prospects or gains of any kind.

1.3 Any figure, example, case study, screenshot, chart or scenario shown anywhere by us is an illustration of what has happened or of how something works. It is not a projection, a forecast, a target or a promise of what will happen for you.

2. Results are not typical and cannot be predicted

2.1 Where results are described, they are the results of a specific person in specific circumstances at a specific time. They are not typical, they are not average, and they should not be understood as what you can expect.

2.2 Outcomes depend on factors that are personal to you and outside our control, including your skill, your existing audience, the quality and originality of your work, the time and effort you put in, your consistency, your market, your language, your budget, and ordinary chance.

2.3 Many people who buy educational programmes of this kind make no money at all. That is a normal outcome and you should assume it is a possible outcome for you.

3. YouTube monetization is not guaranteed

3.1 Acceptance into the YouTube Partner Programme, continued monetization, revenue share, RPM, reach and channel status are decided by YouTube, not by us.

3.2 YouTube's policies, eligibility thresholds, monetization rules, recommendation systems and enforcement practices change without notice, are applied at YouTube's discretion, and can result in demonetization, restriction, strikes or channel termination.

3.3 We have no control over, and accept no responsibility for, any platform decision affecting your channel or your income. The same applies to every other third-party platform, distributor, store, streaming service or AI tool referenced in the Programme.

4. What the Programme actually is

4.1 The Programme provides education, tutorials, community access, software access, an AI coaching assistant and live sessions. It provides information, tools and coaching.

4.2 It does not provide a business opportunity, a franchise, a job, a placement, a client, a distribution deal or a guaranteed audience.

4.3 It is not, and does not contain, financial, investment, tax, accounting or legal advice. It is not personalised advice about your situation. Consult a suitably qualified professional before making any financial decision.

5. Your acknowledgement (anti-reliance)

5.1 By purchasing, you confirm that you were not induced to enter into this contract by any representation, promise, guarantee or claim, of any kind, about income, earnings, revenue, subscriber numbers, monetization or business results.

5.2 You confirm that no such representation was made to you in any sales call, video call, message, email, advertisement, video, social media post or conversation, and that you have not relied on any such representation.

5.3 If anyone acting for us, or claiming to act for us, has made an income or results claim to you, do not purchase. Tell us at support@cyvril.com first.

5.4 What this acknowledgement is not. It is a statement of what we understand to be true, not a shield. If an income or results claim was in fact made to you by us or by anyone acting for us, in a sales call, a video, a message or anywhere else, this Section 5 does not undo it, does not stop you relying on it, and does not exclude or limit our liability for it. We do not apply Sections 5.1 and 5.2 against a consumer, and we will not argue in any forum that they defeat a claim about something that was actually said. If you were told something that turned out not to be true, tell us and we will refund you in full, whether or not the 14 days in the Refund and Withdrawal Policy have passed.

6. Testimonials and examples

6.1 Testimonials, reviews, member stories, before-and-after examples and published work shown by us are individual experiences. They are not promises, are not guarantees, and are not representative of what most members achieve.

6.2 Testimonials are published as given. We do not pay for testimonials, and where any material connection exists between us and a person giving a testimonial (including free access, discounts, commission or an affiliate relationship), we disclose it alongside the testimonial.

6.3 Our own channel statistics, where cited, describe our own channels and our own results. They are not a prediction of yours.

6.4 We only publish testimonials with the member's consent, we disclose any incentive given for them, and we do not present any testimonial as a typical result.

7. No substantiation, no claim

7.1 It is our standing rule that no income or performance claim is made anywhere in our marketing, sales calls, videos or member communications unless we hold written substantiation for it from our own records.

7.2 If we ever make a specific performance claim, you may request the substantiation for it by writing to support@cyvril.com, and we will provide it in the language in which the claim was made. We give this undertaking deliberately, knowing it is wider than the law requires of us, because a claim we cannot show you is a claim we should not have made.

7.3 This document is the floor, not the control. The same rule governs the sales call, the outreach messages, the landing page, the ads and every video we post on our own channels: no income or performance claim without written substantiation, and no claim that this disclaimer would have to rescue.

8. Payment processor rules

8.1 We do not present the Programme as a get-rich-quick scheme, an investment, a money-making opportunity with high rewards for little effort, or a fast and easy income route, and we do not use high-pressure sales tactics, artificial urgency or fabricated testimonials.

8.2 The Programme is described to our payment processor in the same words we use with you: a paid education and community membership with software access, sold at a stated price, with the 14-day full refund set out in the Refund and Withdrawal Policy.

9. Severability and precedence

9.1 If any part of this disclaimer is held unenforceable, the rest continues in force.

9.2 Nothing in this disclaimer excludes or limits liability for fraud or fraudulent misrepresentation, or any liability that cannot lawfully be excluded, or any mandatory consumer right you have under the law of your country of residence.

In one sentence: we teach you how we do this, we give you the tools and the coaching to do it yourself, and we promise you nothing about the money.
